PATENT LAW 08-98-918-01

The course will cover the basic nature of patents; patentable subject matter; the three essential requirements of invention, novelty and utility; the nature and requirements of the patent specification and the principles relating to its construction; substantive and procedural aspects of challenges to the validity of patents; detailed consideration of the issues relating to infringement of patents including literal and substantive infringement, the types of acts which constitute infringement and remedies for infringement; patent litigation; ownership and licensing of patents. The emphasis will be upon principles as applied in Canada, but reference will be made to comparable developments in England, the United States and other jurisdictions where it is considered that is material.
